Please read these terms of sale carefully before placing your order and retain a copy of these terms and your order for future reference. These terms and conditions apply to all wines, spirits or other goods or services supplied by the Fareham Wine Cellar. Use of the Fareham Wine Cellar web site is on condition you agree to the terms and conditions of www.farehamwinecellar.co.uk which from time to time are subject to change and that any future use of the site will renew such an agreement. The Fareham Wine Cellar / www.farehamwinecellar.co.uk makes every effort to ensure the information listed on the website is accurate and up-to-date but there are times due to circumstances beyond our control when the vintage or price may change. We will always keep you informed of any changes made to your order request. Please also make sure you are aware of our Delivery Terms and Conditions

How to Order

You may order wines, spirits or other goods by the various methods mentioned below (unless stated otherwise). You will have a right to cancel such order, please see the paragraph headed “return of goods / cancellation” below for details.

Methods of ordering

1. Via Our Website

Fareham Wine Cellar online payments are securely processed by Barclaycard using an embedded payment form. We recommend that customers order this way. When you have all the items you wish to purchase in your basket, it is recommended that you read the terms and conditions, shipping information and privacy policy. Payments from via Mastercard, Visa Maestro, Visa, Visa Debit and American Express are accepted.

For your convenience, you may enter an alternative delivery address and any other specific details on the account and checkout pages in the applicable areas which are clearly represented.

Prices

All our prices are quoted in Pounds Sterling (GBP) and include VAT at 20%.

There is a case discount of 5% on orders of 1 case (12 bottles or 9L equivalent) or more on wine but not spirits – cases can be mixed.

The description and prices payable for the items or services that you order are clearly set out in our price list or website. If, by mistake, we have under-priced an item or service, we will not be liable to provide that item to you at the stated price provided that we notify you before we despatch the item concerned or, in the case where we are not despatching an item, within 2 working days of our acceptance of your order and we may cancel your order provided we refund you any payments you have made. You may agree the correct price in which case we will proceed with your order. In the unlikely event that an item has been over charged a full refund of the difference will be given.

We reserve the right to change our prices. Please refer to our website for all current prices. Please note prices issued on our website supercede any prices set out in these terms and conditions if they are different.

Prices listed for wines are quoted per bottle, unless otherwise stated. A case is equivalent to 12 bottles (9 litres).

Jeroboam 3 litres
Methusaleh 6 litres
Salmanzar 9 litres

Standard bottle sizes for spirits / liqueurs are 70 cl, unless specified.

Prices are subject to currency and market fluctuations, changes in duty and VAT as well as stock remaining unsold. All prices exclude delivery charges.

Payment Processing

All payments to Fareham Wine Cellar are handled by Barclaycard, a trading name of Barclays Bank PLC. Fareham Wine Cellar does not receive customer’s payment details.

We recommend that you check the details of the items you are ordering before making your purchase. We can accept online payment by Mastercard, Visa Maestro, Visa, Visa Debit and American Express.

We can also accept payment by bank transfer – please contact us for further information. In the case of all orders goods will only be dispatched when cleared funds have been received into our bank account.

Orders may be delayed by transfers of money or credit card authorisations not being confirmed by the respective banks. Please note that it is the customer’s responsibility to contact their bank to speed up this process if the order is required urgently. Credit cards are always debited in UK pounds sterling.

All goods remain property of the vendor until paid for in full.

How The Contract is Formed Between You and Us

After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.

The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Product has been confirmed in a separate Dispatch Confirmation

Delivery

Please refer to our separate delivery page for terms and conditions and delivery charges.

Orders received by 1pm will be dispatched the same day. Standard delivery time frame is 24-48 hours provided that the item is in stock.

We stock most items that are listed on our website and are able restock regularly for items that go out of stock. We aim to process orders as soon as possible, but obviously wines can go out of stock from time to time. This means we will not always be able to deliver the next day.

We will then contact you to advise you of the delivery time frame we can meet, or recommend an alternative wine or refund your payment if you do not want to proceed with the order.

If you need the wine for a particular date, or before a particular date please make sure you mention this in the comments section when placing your order.

When you place an order with us you will be sent an e-mail confirming receipt of your order and setting out the details. Your order represents an offer to purchase from us, which is accepted by us when we contact you (usually by email but sometimes by telephone) with confirmation stating that we have dispatched the goods to you.

Please note delivery times can be longer at peak times e.g. in the lead up to Christmas.

Age Restrictions

We do not sell wine to anyone who is under the age of 18. That is the law. By placing an order with The Fareham Wine Cellar you are confirming that you are at least 18 years old.

The recipient of any deliveries must be over the age of 18 years old. Likewise, if you are buying a gift, the recipient must also be over 18 years old.

All goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the goods may be retained by the driver, in which case the driver will leave notification of attempted delivery and a telephone number for you to rearrange delivery.

Once the wine has been delivered, according to your original delivery instructions, it becomes the recipient’s responsibility.

Claims, Breakages and Refunds

Customers are requested to carefully check all goods at the time of delivery. The delivery or carrier’s note should be signed noting any shortages or breakage. We regret we cannot accept claims for shortages or breakages not recorded in this way. All packaging / breakages must be retained for inspection in the event of any claims, which should be made within 24 hours of receipt of goods. We must have confirmation of any breakages or shortages within 24 hours of delivery, either by telephone, email or fax. We are committed to providing our customers with an unsurpassed level of service and are equally committed to ensuring we provide a safe and legal product. If a wine is corked or faulty we will offer a replacement or credit on the return of the bottle in question. Please contact us immediately by email to info@farehamwinecellar.co.uk and we will organise a refund. We may request the return of the damaged / faulty product before a refund is given so that we can make an assessment as well. Shipping and handling charges are not refundable unless the goods delivered were incorrect, damaged or faulty (this does not affect your statutory rights in the event of faulty goods).

Warranty

We warrant that any product purchased from us is of satisfactory quality. If you have any reservations or comments about the appearance of or quality of our products, you should state these on our carrier’s delivery statement. Alternatively, you must notify us of any complaints you may have within 7 days. Unless we receive such a complaint from you within the period stated, you will be deemed to have accepted delivery of the products in accordance with your order.

We undertake the proper safekeeping and storage of wines in our possession and will act in good faith when purchasing wine for resale but we will not be responsible for the state and condition of wines or whether the wine corresponds to the qualities which might be expected from its description.

If we supply any wine which upon receipt our customer is not satisfied with in appearance, then we will accept the wine back for full refund, provided it is returned to us in the same condition as when shipped by us. We expect any claims in this respect to be made within the aforementioned 7 days of your receipt of the wine.

With regard to wines older than 20 years, we do not accept an open-ended unconditional liability for the condition of the wine in the bottle. With older wines it is quite normal to find that individual bottles can mature, improve, and decline in taste at different times. Whilst we take every effort to ensure that the wines we purchase have been well-kept and are of good provenance and appearance, we do not provide an unlimited warranty as to their taste. However, at our complete discretion, we will consider replacing the remainder of any case sold which is not drinkable.

Privacy Statement

Fareham Wine Cellar is absolutely committed to protecting the privacy of customers. Whilst we do obtain identifying personal information from customers, such as names, email addresses and delivery addresses, this information is only collected for the purpose of fulfilling our orders. We do not use this information for any other purpose, or share or trade this information with any other parties. We also collect email addresses via Campaign Monitor for our newsletter. It is of utmost importance to Fareham Wine Cellar that your personal details are kept personal. Force Majeure

www.farehamwinecellar.co.uk will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond its reasonable control.
